FitnessFeed

Terms of Service

The short version

These Terms are an agreement between you and Derrick Michael Guthier, an individual developer who makes FitnessFeed. In these Terms, "we" means Derrick Michael Guthier. By creating an account or using FitnessFeed, you agree to them. If you don't agree, please don't use the app.

In plain language:

Our Privacy Policy explains how we handle your information and is part of these Terms. Apple's standard end user license agreement for apps also applies to your use of the app.

Who can use FitnessFeed, and your account

Age. You must be 18 or older. When you create an account we ask for your date of birth to check this, as described in our Privacy Policy. If we learn that someone under 18 has an account, we will close it.

Your account. You agree to:

We may refuse or close an account that breaks these Terms.

Not medical advice

FitnessFeed is a way to track your own numbers and share them with friends. It gives general information only, and it is not a medical device or a substitute for a doctor, registered dietitian, or other qualified professional.

You use any suggestion or information in the app at your own risk.

Your content and photos

You own it. What you post, such as comments, captions, goals, and progress photos, stays yours.

What we need from you. To run the app, you give us permission to store your content and show it to the people you choose to share it with, such as your friends and the members of a challenge you join. This permission ends when you delete the content or your account, except for copies that remain for a short time in routine backups.

What you promise. You will only post content that you have the right to share, and you won't post photos of other people without their permission.

Photos are private until you share one. Once you share a photo, anyone who can see it could save or screenshot it. We can't prevent that, so please share only what you are comfortable with.

Sharing is your choice. You decide which health numbers friends can see, and you can change those settings at any time.

Community rules

We have no tolerance for objectionable content or abusive behavior. Don't use FitnessFeed to:

These rules apply to everything you post, including your display name, username, comments, captions, challenge names, and photos.

Reports, blocking, and enforcement

Filtering. FitnessFeed automatically blocks some text, such as certain words in names, comments, and captions. Photos from friends are blurred until you tap them, unless you change that setting.

Reporting. You can report a post, comment, photo, or person from inside the app. The person you report is not told it was you.

Blocking. You can block anyone. A block ends the friendship and hides each of you from the other.

What we do. We review reports and aim to act on them within 48 hours. Depending on what we find, we may remove content, warn you, suspend your account, or delete it. We may do this without notice when the rules are broken, and we may remove content or accounts even when no one has reported them.

Contact. To reach us about a safety concern, email support@fitnessfeed.net.

Ending your account, and legal limits

Leaving. You can delete your account at any time in the app: open Me, then Privacy & safety, then Delete account. We may also suspend or close accounts that break these Terms.

The service. FitnessFeed is provided "as is" and "as available." We may change, pause, or stop any part of it. We try to keep it running and your information safe, but we can't promise it will always be available or free of errors.

Other people. Other users are responsible for what they post. We don't control their behavior and can't guarantee what they share.

Limits of liability. To the fullest extent the law allows, we are not liable for indirect or consequential losses arising from your use of FitnessFeed, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim, or $50 if you paid nothing. Nothing in these Terms limits rights that the law says can't be limited, including liability that cannot be excluded by law.

Changes, law, and contact

Changes. We may update these Terms. If we make a significant change, we will tell you in the app before it takes effect. If you keep using FitnessFeed after that, you accept the updated Terms.

Which law applies. These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-law rules. This does not take away any consumer rights you have under the law where you live.
